§1 Scope of Application

apply exclusively to your order of goods, in the version valid at the time of the order.

(2) Deviating terms shall only apply if confirmed in writing by BGN Marketing GmbH.

§2 Conclusion of Contract

(1) Our product and price information within the ordering process is non-binding and subject to change. By placing an order, you submit a binding offer. This offer is accepted by BGN Marketing GmbH once we assign an order number to it.

(2) Until this point, we are entitled to withdraw from delivery in case of non-availability. The right to delivery arises only upon acceptance of the offer.

§3 Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period begins after receipt of this information in text form, but not before receipt of the goods by the recipient (in the case of recurring deliveries of similar goods, not before receipt of the first partial delivery) and not before we have fulfilled our information obligations according to Art. 246a of the Introductory Act to the German Civil Code (EGBGB).

To exercise your right of withdrawal, it is sufficient to send the withdrawal notice or the goods back in due time.

Consequences of Withdrawal

In the event of a valid withdrawal, the services received on both sides must be returned and any benefits (e.g., interest) must be surrendered. If you cannot return the received goods in whole or in part, or only in a deteriorated condition, you may be required to provide compensation for the lost value.

This does not apply if the deterioration is solely due to the inspection of the goods – as would have been possible in a retail store.

Goods suitable for parcel shipping must be returned at our risk.

  • You shall bear the direct costs of return shipping if the delivered goods correspond to the ordered goods and the price of the returned goods does not exceed €40, or if, in the case of a higher price, you have not yet provided the consideration or a contractually agreed partial payment at the time of withdrawal.
  • Otherwise, the return shipment is free of charge for you.

Non-parcel goods will be collected from you.

Refunds must be made within 14 days. The period begins for you with the dispatch of the withdrawal declaration or goods, and for us upon receipt.

§4 Prices

(1) All prices include statutory VAT and apply ex BGN Marketing GmbH, unless otherwise agreed. Additional shipping costs, customs duties, and fees for international deliveries are to be borne by the customer.

(2) Shipping costs within Germany:

  • For orders up to €150, we charge €7.49 per order.
  • From €151 order value, we deliver free of shipping costs.

(3) Shipping costs within the EU: flat rate of €17.99 per order.

(4) Shipping costs outside the EU: flat rate of €24.99 per order.

Delivery is made net, without German VAT. Additional customs duties, taxes, or fees may apply and are to be paid by the customer to the relevant authorities.

§5 Terms of Payment

(1) Orders can be paid in advance, via PayPal, or by credit card.

(2) In case of advance payment, you will receive an order confirmation including our bank details. The total amount must be transferred within 7 working days.

§6 Delivery / Delay in Delivery

(1) Delivery is made to the address specified by the customer.

(2) Shipments are carried out from Germany via shipping service providers.

(3) If BGN Marketing GmbH is unable to deliver the ordered goods through no fault of its own (e.g., supplier default), we are entitled to withdraw from the contract. The customer will be informed immediately. Statutory rights of the customer remain unaffected.

§7 Liability for Defects

(1) If the purchased goods are defective, the customer may request subsequent performance (rectification or replacement delivery). If subsequent performance fails, the customer may withdraw from the contract in case of significant defects, reduce the purchase price, or claim damages.

(2) If subsequent performance is provided by way of replacement delivery, the customer is obliged to return the initially delivered goods within 30 days.

(3) The limitation period for defect claims is 24 months from delivery.

(4) Products that have already been opened or used cannot be returned for hygiene reasons.
